I. GENERAL<\/h3>
\u00a0<\/div>

We are pleased to welcome you to mybestlessons.com<\/strong>, the online Platform through which users who wish to receive education on scientific, athletic, artistic, cultural, and other subjects (hereinafter referred to as \u201cstudents,\u201d \u201cyou\u201d) are connected with the teacher Dimitris Nikoloudakis (hereinafter referred to as the \u201cTeacher\u201d).<\/p>

The Service is provided to Students who register for it (hereinafter the \u201cMembers\u201d or \u201cUsers\u201d). The Service is made available to its Members for the offering and requesting of educational services. In particular, Student Members may, through any device (mobile phone), computer, or generally any electronic means, search for educational programs of their interest and carry out initial communication regarding them (hereinafter referred to as the \u201cService\u201d).<\/p>

The mybestlessons.com Platform<\/strong> (the \u201cPlatform\u201d) operates at mybestlessons.com<\/strong> (the \u201cWebsite\u201d).<\/p>

Completion of company details<\/em><\/p>

The Company operates through the Service as a provider of educational or consulting services and offers the possibility for Students to submit an expression of interest (\u201clesson request\u201d) in order to select a specific online educational service or program. The request includes the Students\u2019 details, such as full name, mobile phone number, email address, and their message of interest. Subsequently, the Teacher contacts the interested Student.<\/p>

The following General Terms and Conditions for the Use of the Platform and the Service (hereinafter the \u201cGeneral Terms of Use\u201d or the \u201cGeneral Terms\u201d) have been established by the Company for the use of the Platform and the Service and define the terms and conditions under which the Company provides the Service to the Members who use it. They constitute legally binding terms and conditions between the Company and its Users regarding its use and apply whenever a User accesses the Platform, browses it, or visits the Website.<\/p>

By accessing and browsing the Platform and\/or registering as a Member and\/or using the Service, Users confirm that they have read, understood, and unconditionally accepted these General Terms (including the Privacy & Cookies Policy and the Acceptable Use Policy).<\/p>

If a User disagrees with any term or with all of them, they must refrain from using any of the services provided through the Platform (e.g. newsletter subscription, browsing, opening advertising links, etc.) and must not register on the Platform or use the Service. Downloading the Application and\/or registering as a Member on the Platform or using the Service implies the unconditional acceptance of and compliance with these General Terms. Each time Users access the Platform and use the Service, they reconfirm their agreement with the Company to these General Terms.<\/p>

The Company reserves the right to modify, renew, delete, add, or limit unilaterally:
a) these Terms of Use, in whole or in part,
b) its Policies,
c) the Service,
d) the technical specifications of the Platform, etc.
(hereinafter the \u201cChanges\u201d), at its absolute discretion and\/or whenever any such change is required by law, possibly without prior notice or consent, always within the framework of good commercial practice and the limits set by law.<\/p>

The Company undertakes to inform Users of any such Changes via the Website and\/or through a relevant notification upon Users\u2019 entry to the Platform. Such Changes shall be effective from the date of their publication. It is clarified that any modification of these Terms of Use does not affect events, transactions, or uses of the Platform and the Service already carried out by Users prior to the effective date of the Changes and accepted by the Company.<\/p>

If Members wish to receive clarification or information regarding these Terms of Use or any Changes, or if they have any disagreement, reservation, or question related to the terms (including any modifications), they may contact the Company via email before performing any action on the Platform.<\/p>

Any action, use, or transaction carried out by Members on the Platform, including the use of the Service itself, after the aforementioned Changes, is deemed as unconditional acceptance thereof.<\/p>

The Company reserves the right at any time, without cause and without prior notice to the Member, to cancel, suspend, or terminate the operation of the Service, abolish or modify the Platform, or specific functions or features of the Platform and the Service.<\/p>

The use of the Platform and the Service by Users and any transaction conducted through the Platform is carried out at their sole responsibility.<\/p>

Members acknowledge and understand that they must comply with the terms of use of the provider associated with their device (the \u201cProvider Terms of Use\u201d). The Provider Terms of Use are deemed incorporated herein. It is the sole responsibility and obligation of Users to identify the Provider Terms of Use applicable to their device.<\/p>

BY ACCEPTING THESE TERMS AS SET OUT ABOVE, USERS (INCLUDING AUTHORIZED USERS) EXPRESSLY AND UNCONDITIONALLY DECLARE THAT THEY ARE OF LEGAL AGE TO BE BOUND BY THESE GENERAL TERMS REGARDING THE USE OF THE PLATFORM AND THE SERVICE AND THAT THEY OPERATE LAWFULLY AND HAVE OBTAINED ALL NECESSARY APPROVALS AND LICENSES FOR THEIR REGISTRATION ON THE PLATFORM AND THE USE OF THE SERVICE.<\/strong><\/p>

With the registration and use of the Service, Members agree that any claim they may have against any third party or Member for any actions and\/or omissions is limited to those persons, and no liability shall be attributed to the Company for such actions or omissions.<\/p>

II. REGISTRATION ON THE PLATFORM AND USE OF THE SERVICE<\/h2>

A. MEMBER REGISTRATION<\/h3>

1. Purpose<\/h3>
\u00a0<\/div>

The registration of Students on the Platform by opening an Account constitutes a necessary prerequisite for the use of the Service. By opening and maintaining an Account, the Student Member acquires, in addition to browsing, the ability to connect and communicate with the Teacher.<\/p>

Registration and participation as a Member are personal, non-transferable, and non-assignable. Members are responsible for the accuracy, truthfulness, and updating of the data they provide to the Platform, and the Company relies exclusively and solely on their declarations regarding the data and information provided.<\/p>

The personal data that Members provide during their registration for the Service, as well as the data and information generated or transmitted on the Platform by the Members, or through it within the context of the Service, are processed by the Company in accordance with the terms and provisions of these General Terms of Use and the Company\u2019s Privacy Policy.<\/p>

By registering in accordance with the above, the Member expressly consents to the collection and processing of their data and information pursuant to these General Terms and the Company\u2019s Privacy Policy, which the Member declares that they have read, understood, and fully and unconditionally accepted.<\/p>

2. Student Registration<\/h3>
\u00a0<\/div>

The registration of the Student on the Platform is quick and simple:<\/p>

a) either via Facebook or Google, in which case the Company processes only the data required for the purpose of the Student\u2019s registration on the Platform (see in detail the Company\u2019s Privacy Policy),
b) or by entering an email address and a password.<\/p>

By accepting these Terms of Use and the Company\u2019s Privacy Policy, the Student submits their registration application to the Platform. The Platform sends the applicant Student an SMS message to the mobile phone number declared at the beginning of the registration process or during the submission of an expression of interest to the Teacher, containing a four-digit code which must be entered on the Platform in order to complete the registration and activate the Student\u2019s Account on the Platform.<\/p>

Following registration, the Student will have the ability to submit a request to connect with the Teacher in order to attend a specific Lesson.<\/p>

3. Deactivation \u2013 Deletion of Account<\/h3>

3.1 Deactivation options by the Student<\/h4>
\u00a0<\/div>

The Student may deactivate their account at any time, without cause or cost. The Company securely deletes all personal data entered by the Student in its database immediately.<\/p>

In the event of deletion of the Account by the Student, the Company retains in its database only the evaluations regarding the quality of the services provided by the Teachers that the Student has received.<\/p>

For information regarding the retention of your personal data following the deletion or deactivation of your Account, please refer in detail to the Privacy Policy.<\/p>

B. USE OF THE SERVICE<\/h2>

1. Description of the Service<\/h3>
\u00a0<\/div>

The Service primarily concerns Students who are interested in connecting for the provision of one or more Lessons. Through the Service, the Student has the ability to connect with the Teacher and submit a request in order to reach an agreement regarding one or more Lessons of their choice.<\/p>

3. Financial Policy of the Service<\/h3>

3.1 Pricing and Payment<\/h4>
\u00a0<\/div>

The Service is provided to the Student free of charge, without any obligation to pay a fee.<\/p>

3.2 Payment Methods<\/h4>
\u00a0<\/div>

Payment is made either by deposit into the Company\u2019s bank account or by credit or debit card. For certain payment methods, your bank may apply additional charges and taxes; please verify this with your account or card provider.<\/p>

3.3 Changes to Pricing Policy and Charges<\/h4>
\u00a0<\/div>

mybestlessons.com<\/strong> reserves the right to modify its price lists for subscriptions without prior notice and without prior individual notification to the Member, following only prior publication of the upcoming change through the Platform, in accordance with applicable legislation.<\/p>

Continued use of the Platform shall be deemed automatic acceptance of the new charges. If you do not agree with the changes in charges, you may terminate your agreement with us by deactivating your Account and cancelling your subscription.<\/p>

4. STUDENT OBLIGATIONS<\/h2>

\u00a0<\/div>

The Student is required to use the Service and the Platform in accordance with these General Terms. More specifically, all content and material used must comply with the terms related to expressions of interest, as defined in the relevant section of these Terms.<\/p>

The Student is responsible for any comment or rating submitted regarding any Teacher. Any such comment must be fair, honest, and reasonable.<\/p>

  1. For verifying the information provided by the Teacher.<\/p><\/li><\/ol>

    For the use of the Platform\u2019s Service, the Student is required:<\/p>

    1. Not to provide information which they know to be inaccurate, incorrect, incomplete, false, or which is or could be considered a misrepresentation of facts.<\/p><\/li>

    2. Not to make bad-faith use of the Service and to declare only genuine Lessons in which they are truly interested.<\/p><\/li><\/ol>

      It is the sole responsibility of the Student, as a User, to decide whether a Lesson is suitable for them, meets their preferences, and to carefully select the Teacher who will provide it.<\/p>

      The use of the Platform is governed by the provisions of Greek law, European Union law, and International law, which are binding on each user\/visitor, who is obliged to comply with them. In addition, the user\/visitor is required to use the content and services of the Platform in accordance with applicable legislation, public morals, and these Terms, refraining from any action that may infringe the dignity and personality of Users or third parties or disrupt the proper operation of the Platform.<\/p>

      Where a Teacher agrees to provide services to Students, they expressly assume the associated risk. It is the exclusive responsibility of Teachers to make decisions that are in the best interests of themselves and the Students, as applicable.<\/p>

      The Student acknowledges and agrees that the Service provided by the Platform is limited to offering a means through which they may attempt to communicate with Teachers. When using the Service, the Platform does not guarantee:<\/p>

      1. That you will find Lessons suitable for your personal requirements.<\/p><\/li>

      2. That the details\/data of Teachers are authentic.<\/p><\/li>

      3. Compliance with any specific quality standard.<\/p><\/li>

      4. The status or condition of any Teacher.<\/p><\/li>

      5. That the information and documents displayed on a Teacher\u2019s profile are authentic, valid, accurate, or complete.<\/p><\/li>

      6. As a User, the Student warrants that they will use the Service solely for personal use and not for any commercial purpose, including, without limitation, the resale of the Service.<\/p><\/li><\/ol>

        Lessons are provided by the Teacher in accordance with the terms and conditions that may be agreed between the Student and the Teacher. In the event of any dispute between the Student and any Teacher, the Company bears no responsibility whatsoever (including, but not limited to, any damage or injury) that any Member may suffer during the process, and the Company is released from any liability for anything a Member may incur or for anything related to such dispute.<\/p>

        Comments and other material published on or provided through the Platform are not intended to be used as advice upon which reliance should be placed. Therefore, the Company disclaims all liability arising from any reliance placed by any Member or any person who may become informed of such content. Furthermore, responsibility for decisions made based on information, indications, or advice provided through the Platform remains exclusively personal to the Member.<\/p>

        The Company does not wish in any way to participate in, nor may it be considered responsible for, any communication, transaction, meeting, arrangement, or relationship between a Member and other Users. Consequently, the Company recommends that each Member take all necessary precautions when communicating with others, socializing, or participating in social gatherings or meetings, including, without limitation, transactions with other Users.<\/p>

        III. LEGAL STATUS OF THE PLATFORM<\/h2>

        1. General<\/h3>
        \u00a0<\/div>

        The activity of mybestlessons.com<\/strong> concerns the provision of teaching services for the Teacher.<\/p>

        2. Rights and Obligations of the Company Regarding the Use of the Platform<\/h3>

        2.1 Permanent Deletion of a Member Account<\/h4>
        \u00a0<\/div>

        In addition to the cases referred to in these General Terms regarding the deletion of a Member Account, mybestlessons.com<\/strong> expressly reserves the right to delete a Member\u2019s Account if, at the Company\u2019s sole discretion, the Member violates the Acceptable Use Policy of the Service and\/or violates any term or provision of these General Terms and\/or has committed, in the Company\u2019s judgment, a criminal or other unlawful act during the use of the Service and\/or has caused an immediate risk or damage to the Company and\/or to any Member, or for any other serious reason not expressly mentioned herein.<\/p>

        In such cases, the deletion of the Account shall be immediate and automatic, without granting the Member the right to remedy the violation. The Company expressly reserves all its legal rights, including the right to seek compensation for any damage it may have suffered due to the actions and\/or omissions of its Members as described above.<\/p>

        2.2 Temporary Deactivation of a Member Account<\/h4>
        \u00a0<\/div>

        In addition to the cases referred to in these General Terms regarding the deletion of a Member Account, mybestlessons.com<\/strong> expressly reserves the right, at its sole discretion, to temporarily deactivate a Member\u2019s Account immediately and without compensation, if it determines that the Member has violated any term hereof, or has violated applicable legislation (e.g. data protection laws), or has overdue financial obligations towards the Company, until such violation is remedied within the time period set by mybestlessons.com<\/strong> at its sole discretion.<\/p>

        In the event of non-compliance by the Member, mybestlessons.com<\/strong> may permanently deactivate the Member\u2019s Account, expressly reserving all its legal rights, including the right to seek compensation for any damage suffered as a result of the Member\u2019s actions and\/or omissions.<\/p>

        It is expressly agreed that the Member shall not be entitled to claim compensation for any damage resulting from the permanent or temporary deactivation of their Account, even if the indications upon which the Company based its decision were erroneous, as the Member acknowledges and accepts that the automated means used by the Company to detect unlawful or non-compliant activities may be based on standardized or automated software commands that may contain errors and\/or on reports submitted by other Members.<\/p>

        It is understood that a Member whose Account has been deleted is prohibited from re-registering for the Service using the same or different details, unless mybestlessons.com<\/strong> expressly consents thereto. For this purpose, the Member consents to mybestlessons.com<\/strong> retaining their personal data in its system in order to identify any subsequent attempt to re-register.<\/p>

        Any outstanding debts of the Member to the Company become immediately due and payable.
        Any reviews submitted and received by a Member shall continue to be displayed even after the loss of Member status.<\/p>

        2.3 Interruption of the Service<\/h4>
        \u00a0<\/div>

        mybestlessons.com<\/strong> reserves the right, for technical reasons, maintenance, and\/or upgrade of the Platform, to temporarily interrupt the operation of the Service at regular intervals. In the event that such interruption exceeds a reasonable period of time at the sole discretion of mybestlessons.com<\/strong>, or if a scheduled interruption has been predetermined, mybestlessons.com<\/strong> shall inform its Members through a relevant announcement on the Platform.<\/p>

        It is expressly agreed that Members may not raise any claims against mybestlessons.com<\/strong> for any damage they may suffer for this reason, even if mybestlessons.com<\/strong>, at its sole discretion, does not notify them of such interruption.<\/p>

        In addition to the foregoing, mybestlessons.com<\/strong> may at any time terminate, modify, suspend, or discontinue any individual function of the Service, including the availability of the Service itself, with or without notice.<\/p>

        2.4 Provision of Information<\/h4>
        \u00a0<\/div>

        mybestlessons.com<\/strong>, if requested by a competent prosecutorial, supervisory, judicial, or other authority, is obliged to transmit Member data, including any personal data provided to mybestlessons.com<\/strong> under these Terms, and any other information made available to it, without prior notice or consent of the individuals concerned, where required for the protection of state and public security and for the prosecution of criminal acts, including tax-related offenses and violations.<\/p>

        3. Limitation of Warranties and Obligations Regarding the Use of the Platform<\/h3>
        \u00a0<\/div>

        mybestlessons.com<\/strong> always acts in good faith and within the framework of the law and these General Terms. Accordingly, it has taken and continues to take all necessary technical and other measures and makes every reasonable effort to ensure that (a) the Service operates properly and without interruptions, delays, errors, or malfunctions, and (b) the technology it uses or the servers through which the Service is provided do not contain viruses or other harmful components; however, NO WARRANTIES ARE PROVIDED<\/strong> in relation to the above.<\/p>

        Furthermore, mybestlessons.com<\/strong> provides no warranty regarding:
        (a) the suitability, effectiveness, or adequacy of the Service for the purpose for which the User uses it,
        (b) the proper performance of transactional obligations between Users,
        (c) the suitability of the educational services provided.<\/p>

        The Service is provided \u201cas is\u201d and \u201cas available,\u201d in a fully automated manner, and does not include the manual input of any data by the Company nor any ad hoc customization. The Service may be modified in the future at the sole discretion of the Company.<\/p>

        mybestlessons.com<\/strong> takes all necessary technical and other measures to ensure Users\u2019 compliance with these Terms and applicable law; however, as an Information Society Service Provider, it has no general legal obligation to:
        (a) monitor information provided to it,
        (b) actively seek facts or circumstances indicating unlawful or non-compliant activity by Members,
        (c) verify authorizations or the legal capacity of Authorized Users acting on behalf of Users,
        (d) monitor compliance by Users with tax law, data protection law, consumer protection law, or other applicable legislation in their transactions with one another.<\/p>

        4. Limitation of Liability for the Use of the Platform<\/h3>
        \u00a0<\/div>

        In addition to what is expressly provided herein, mybestlessons.com<\/strong> bears no civil, criminal, or other liability towards the User, the Member, their partners, or any third party deriving rights from them, in the event that any of the above suffers direct, indirect, incidental, consequential, or loss-of-profit damages of any kind, including loss of income, business, reputation, reduced sales, or any other damage, arising from:<\/p>

        (a) delayed or improper transmission, storage, receipt, loss, or destruction of information or content due to errors, omissions, technical failures, network disruptions, internet failures, website issues, or Internet Service Provider failures,
        (b) temporary or permanent deactivation of the Service or deletion of a Member Account,
        (c) acts or omissions of the Company or third parties, including Members, for which the Company bears no warranty or obligation,
        (d) use of User data, including personal data, by Users or third parties for purposes other than the Service,
        (e) violations of data protection or other applicable legislation,
        (f) discrepancies between system time and official time,
        (g) force majeure events.<\/p>

        In addition, it is expressly agreed that Students enter into independent agreements directly with the Teacher<\/strong> through the Platform for the provision of educational services (Lessons).<\/p>

        Under no circumstances does mybestlessons.com<\/strong> adopt or endorse the information presented by Users on the Platform.<\/p>

        IV. OBLIGATIONS OF MEMBERS FOR THE USE OF THE PLATFORM<\/h2>

        1. General<\/h3>
        \u00a0<\/div>

        Members are obliged to keep their Platform access password confidential and not disclose it to any third party without granting the corresponding authorization to use the Service on their behalf. If a Member believes that their password has been stolen or disclosed to a third party without their consent, they must immediately change it; otherwise, they bear sole responsibility for any actions or omissions carried out on the Platform.<\/p>

        Members must respect the intellectual property rights of third parties, their personal data, and their personality rights, and must not infringe upon them through comments, information, or generally through their actions and\/or omissions within the Service.<\/p>

        With regard to the protection of personal data, each Member is required to take appropriate technical, organizational, and legal measures to ensure privacy and information security. It is expressly agreed that Members bear sole responsibility for the legality and accuracy of the information, data, and details they provide to the Platform during registration or use of the Service.<\/p>

        Members expressly and unconditionally declare and warrant that:
        a) They have read and fully understood these General Terms, the Privacy Policy, the Acceptable Use Policy, and any other applicable policies, and fully and unconditionally accept them.
        b) In cases where a third party acts on their behalf (Authorized User), they have obtained all necessary permissions, consents, and authorizations for the provision of the Member\u2019s data, in accordance with applicable data protection legislation.
        c) They have taken and will continuously take all appropriate technical, organizational, and legal measures to ensure confidentiality and the protection of personal data.
        d) At their own responsibility and expense, they shall immediately take all necessary measures and shall fully indemnify and hold harmless the Company from any claim, loss, damage, cost, expense, obligation, liability, penalty, fine, or legal fees arising from:
        e) Any breach of these General Terms, declarations, warranties, or the intellectual or other rights of the Company,
        f) Any unlawful act or omission during the use of the Service.
        g) They have obtained all necessary licenses, consents, and approvals for their registration and use of the Service and that such use does not infringe third-party rights, violate laws, or breach contractual obligations.
        h) All information and data entered on the Platform, both in their profile and in their transactions, are complete, true, and up to date.
        i) Use of the Service is at their sole responsibility and is strictly for personal and not commercial use.
        j) Any action or omission of an Authorized User is deemed approved and accepted by the Member and binds them fully.
        k) Texts and images uploaded to their profile shall not infringe the honor, personality, reputation, data, or intellectual property rights of third parties and shall not include false, vulgar, defamatory, offensive, misleading, or otherwise unlawful content.<\/p>

        V. OTHER SERVICES THROUGH THE PLATFORM<\/h2>

        1. Newsletter Subscription<\/h3>
        \u00a0<\/div>

        By registering for the Service, mybestlessons.com<\/strong>, within the framework of its legitimate interest, may send informational newsletters to the email address you have provided. For personal data protection, please refer to the Privacy Policy.<\/p>

        mybestlessons.com<\/strong> is not responsible if newsletters are not delivered, although it makes every reasonable effort in cooperation with Internet Service Providers. Newsletters may end up in spam folders; therefore, Members are required to check regularly.<\/p>

        Members may unsubscribe from newsletters or request complete removal from the mailing system by contacting mybestlessons.com<\/strong> via email or through the unsubscribe link included in each newsletter. The Company uses a third-party provider for newsletter distribution and does not share personal data such as name, address, or other personal information with third parties.<\/p>

        2. Advertisements<\/h3>

        mybestlessons.com<\/strong> reserves the right to advertise on third-party websites and to use advertising partners. Cookies may be used during advertising display, but no personally identifiable data is used.<\/p>

        The Platform may display third-party advertisements, which may contain external links. Advertisers are solely responsible for ensuring their content is lawful, accurate, and non-infringing. Advertisements containing offensive, threatening, pornographic, nudity-related, alcohol-, drug-, gambling-, weapon-, malware-, pyramid-scheme-, illegal-activity-related, or otherwise inappropriate content are strictly prohibited.<\/p>

        Advertisements must be appropriate for the Platform community and must not imply endorsement or partnership with the Company. mybestlessons.com<\/strong> reserves the right to reject or remove any advertisement at any time, even after publication.<\/p>

        The Platform may contain links to third-party websites whose privacy practices and content differ from those of mybestlessons.com<\/strong>. The Company bears no responsibility for third-party content, availability, privacy policies, or services.<\/p>
